नवीन समाचार, नैनीताल, 20 जून 2023। अपर मुख्य न्यायिक मजिस्ट्रेट नैनीताल ज्योत्सना की अदालत ने वर्ष 2010 में नैनीताल जनपद के बेतालघाट में घटित एक घटना के संबंध में दो पुलिसकर्मियों (Policemen) को 12 वर्ष तक चली कानूनी प्रक्रिया के बाद आखिर दोषमुक्त कर दिया है। गौरतलब है कि इस मामले में अब दोषमुक्त किए गए पुलिस कर्मी उस टीम का हिस्सा थे, जिन्होंने एक व्यक्ति को अवैध चरस के साथ पकड़ा था। फिर भी वह 12 वर्ष तक चली कानूनी प्रक्रिया के दौरान आरोपित रहे। इस बीच एक पुलिस कर्मी आरोपों के दाग के साथ सेवानिवृत्त होने को भी मजबूर रहे।
इस मामले में किरण फर्त्याल ने न्यायालय में यह कहकर वाद दायर किया था कि 22 दिसंबर 2010 को दिन के लगभग एक बजे उनके निवास स्थान कालाखेत थाना बेतालघाट जिला नैनीताल में 4-5 लोग हथियारबंद लोग अल्टो कार से आए तथा उन्हें यानी किरण तथा उनके पति विजय फर्त्याल को बलपूर्वक जबरदस्ती गाड़ी में बैठा कर अल्मोड़ा ले गए। जब मौके पर गांव वाले इकट्ठा हुए और उनका विरोध किया गया तो इन हथियारबंद लोगों ने खुद को एसओजी यानी पुलिस का होना बताया तथा गोली चलाने की धमकी दी।
इसके बाद आरोपित किरण तथा उनके पति विजय फर्त्याल को अल्मोड़ा थाना उठा ले गए। वहां दोनों को रात भर थाने में बंद रखा गया तथा सुबह किरण को छोड़कर उनके पति विजय फर्त्याल को झूठे चरस के मामले में फंसा कर जेल भेज दिया। इसके बाद आरोपित आरक्षी देवीदत्त पांडे तथा आरक्षी संदीप सिंह के विरुद्ध भारतीय दंड संहिता की धारा 342, 352, 448, 365 व 34 के तहत यह मामला वर्ष 2011 से न्यायालय में चला। वादी की ओर से अभियोजन ने 8 गवाह पेश किए गए। गौरतलब है कि अदालती सुनवाई के दौरान एक आरोपित आरक्षी देवी दत्त पांडे सेवानिवृत्त भी हो गए।
आरोपितों की ओर से पैरवी करते हुए अधिवक्ता पंकज कुलौरा ने न्यायालय में यह तर्क रखा कि वादी के पति विजय फर्त्याल को उसी दिन तथा उसी समय अल्मोड़ा पुलिस द्वारा 1 किलो 585 ग्राम अवैध चरस के साथ पकड़ा गया था। इसके बाद जिला एवं सत्र न्यायाधीश अल्मोड़ा द्वारा अवैध चरस के मामले में उसे 10 साल का कारावास तथा एक लाख रुपए जुर्माने की सजा सुनाई गई थी। उस मामले में दोनों पुलिसकर्मी पुलिस टीम के सहयोगी थे। इसलिए उन पर कोई अपराध नहीं बनता है। लिहाजा पति को बचाने के लिए पुलिस कर्मियों को झूठा फंसाया गया है।

In this case, Kiran Fartyal had filed a suit in the court saying that on 22nd December 2010, at around one o’clock in the day, 4-5 armed men came in an Alto car at her residence, Kalakhet police station, Betalghat district, Nainital, and she i.e. Kiran and her husband Vijay Fartyal was forcefully taken to Almora by forcefully sitting in the car. When the villagers gathered on the spot and protested against them, these armed men introduced themselves as SOG i.e. police and threatened to shoot.
After this, the accused Kiran and her husband Vijay Fartyal were taken to Almora police station. There both were kept locked in the police station overnight and in the morning except Kiran, her husband Vijay Fartyal was implicated in a false charas case and sent to jail. After this, the case against the accused constable Devidutt Pandey and constable Sandeep Singh under sections 342, 352, 448, 365 and 34 of the Indian Penal Code went on in the court from the year 2011. Eight witnesses were produced by the prosecution on behalf of the plaintiff. Significantly, during the court hearing, one of the accused constable Devi Dutt Pandey also retired.
Appearing on behalf of the accused, advocate Pankaj Kulaura argued in the court that the husband of the plaintiff, Vijay Fartyal, was caught with 1 kg 585 grams of illegal charas by the Almora police on the same day and at the same time. After this, he was sentenced to 10 years imprisonment and a fine of one lakh rupees by the District and Sessions Judge Almora in the case of illegal charas. In that case both the policemen were associates of the police team. That’s why no offense is made on them. Therefore, to save the husband, the police personnel have been falsely implicated.
The court has acquitted both the policemen on the basis of documentary evidence in favor of the policemen and because the plaintiff has not proved his case. Went. Advocates Ritesh Sagar and Sudhir Singh also appeared on behalf of the defence.
