नवीन समाचार, नैनीताल, 27 जून 2023। उत्तराखंड में लोकायुक्त (Lokayukta) की नियुक्ति होना अब करीब-करीब तय हो गया है। राज्य के उच्च न्यायालय ने प्रदेश में लोकायुक्त की नियुक्ति व लोकायुक्त संस्थान को सुचारू रूप से संचालित किए जाने को लेकर दायर याचिका पर सरकार को आठ सप्ताह में नियुक्ति के आदेश दिए हैं।
गौलापार निवासी जोशी ने दायर की थी याचिका
मंगलवार को मुख्य न्यायाधीश न्यायमूर्ति विपिन सांघी व न्यायमूर्ति राकेश थपलियाल की खंडपीठ ने हल्द्वानी के गौलापार निवासी समाजसेवी रविशंकर जोशी की जनहित याचिका पर सुनवाई करते हुए अपने आदेश के अनुपालन की रिपोर्ट पेश करने के निर्देश देते हुए तब तक लोकायुक्त कार्यालय में खर्च पर भी रोक लगा दी है। मामले की अगली सुनवाई 10 अगस्त को होगी।
बिना काम इतना हो रहा खर्च
उल्लेखनीय है कि इस मामले की पिछली सुनवाई पर खंडपीठ ने सरकार से शपथपत्र के माध्यम से लोकायुक्त की नियुक्ति के लिए अभी तक किए गए कार्यों और लोकायुक्त संस्थान के बनने से लेकर 31 मार्च 2023 तक इस पर खर्च हुई धनराशि का वर्षवार विवरण पेश करने को कहा था। इस पर सरकार की ओर से आज बताया गया कि 2010-11 से अब तक आवंटित 36 करोड़ में से करीब 30 करोड़ खर्च हो चुके हैं। इस साल भी दो करोड़ 44 लाख रुपए आवंटित किये गये हैं। यानी लोकायुक्त की नियुक्ति नहीं होने के बावजूद संस्थान के नाम पर हर वर्ष दो से तीन करोड़ रुपए खर्च हो रहे हैं।
राज्य में भ्रष्टाचार की जांच को कोई स्वतंत्र एजेंसी नहीं
उल्लेखनीय है कि याचिका में याची ने कहा था कि कर्नाटक व मध्य प्रदेश में लोकायुक्त के माध्यम से भ्रष्टाचार के विरुद्ध कड़ी कार्यवाही की गई है लेकिन उत्तराखंड में तमाम घोटाले हो रहे हैं और भ्रष्टाचार के छोटे से छोटे मामले उच्च न्यायालय में लाने पड़ रहे हैं। उत्तराखंड राज्य में कोई भी ऐसी जांच एजेंसी नही है जिसके पास बिना शासन की पूर्वानुमति के, किसी भी राजपत्रित अधिकारियों के विरुद्ध भ्रष्टाचार का मुकदमा पंजीकृत करने का अधिकार हो।
स्वतंत्र और निष्पक्ष जांच के नाम पर प्रचारित किया जाने वाला सतर्कता विभाग भी राज्य पुलिस का ही हिस्सा है, जिसका सम्पूर्ण नियंत्रण पुलिस मुख्यालय, सतर्कता विभाग या मुख्यमंत्री कार्यालय के पास ही रहता है।

No independent agency to investigate corruption in the state

There is no such investigative agency in the state of Uttarakhand which has the authority to register corruption cases against any gazetted officers without the prior permission of the government.
The Vigilance Department, which is promoted in the name of independent and fair investigation, is also a part of the State Police, whose complete control remains with the Police Headquarters, Vigilance Department or the Chief Minister’s Office.
In the previous assembly elections, political parties had promised to appoint a strong Lokayukta to end administrative and political corruption when they form the government in the state, but this promise has not been fulfilled till date.
